According to the Miller family, the State of Israel and its agents did not take reasonable steps to identify British cameraman James Miller, who was allegedly holding a white flag, before shooting him.
Miller, who had entered the closed military zone of Rafah two years ago at his own risk, was killed on May 2, 2003, at the age of 34.
An IDF force under the command of a Captain, who cannot be identified for security reasons, was in the area at the time, hunting for arms smugglers' tunnels, when the firefight between soldiers and armed Palestinians -- in which Miller was killed -- broke out.
Miller was discovered wounded by the IDF. He was evacuated to the nearby Tarmit army post, but he died before a helicopter could reach him.
