On Sunday, MK Ahmed Tibi submitted a petition to the Israeli High Court of Justice saying that Israel is violating an article of the Fourth Geneva Convention by not releasing all prisoners who are residents of the Gaza strip.
Article 77 states that when an occupying power withdraws from a territory, it must relinquish prisoners from the territory to the new government.
Israel released three administrative detainees, but has made a distinction between them and "regular" prisoners.
The IDF responded to Tibi by saying that the Fourth Geneva Convention does not require the release of prisoners, especially those who have committed serious security offences. The IDF also said they did not expect that if returned to the Palestinian Authority, the prisoners would be put in jail.
